1. Who we are
Padilla Advisory Group LLC ("PAG," "we") is a tax, corporate and wealth advisory firm located at 2200 N Commerce Pkwy, Ste #200, Weston, FL 33326. This notice explains how we collect, use, share and protect the personal information of visitors to www.padillaadvisory.com and of our prospective and current clients.
2. Laws we follow
The Gramm-Leach-Bliley Act (GLBA) subjects providers of tax preparation and tax advisory services to its privacy and data-protection rules. This does not make PAG a bank or a financial or investment adviser; it means we protect your information to that federal standard. PAG complies with the GLBA Privacy Rule (Regulation P, 12 C.F.R. Part 1016) and the Federal Trade Commission (FTC) Safeguards Rule (16 C.F.R. Part 314). Tax return information is also protected by section 7216 of the Internal Revenue Code (IRC) and its regulations. In Florida we follow the Florida Information Protection Act (FIPA; section 501.171, Florida Statutes). Our professionals are bound by the Internal Revenue Service (IRS) rules of practice in Circular 230.
3. Information we collect
- Information you provide when you email us or message us on WhatsApp: name, email, WhatsApp number, country of residence, advisory area of interest and your message. We do not request Social Security numbers, ITINs (Individual Taxpayer Identification Numbers), bank accounts or documents through the site.
- Information you provide when you engage our services: identification data, taxpayer identification numbers and the tax, financial, corporate, wealth and family information the engagement requires.
- Information generated when you browse: IP address, browser and device type, pages visited and cookie data, as described in section 9.
4. How we use it
To respond to your request, evaluate and deliver the services you engage, meet legal and professional obligations, bill, protect the security of the site and improve how it works. We do not sell or rent personal information, and we do not use it for third-party advertising.
5. Who we share it with
- Group companies under common control, Tax Planning Plus LLC and Solon LLC, solely to perform the service you engaged. These companies will not use your information to market to you without your authorization.
- Your tax return information is used or disclosed only with your prior written consent where IRC section 7216 requires it.
- Andrade Insurance Broker and any other nonaffiliated third party: only with your express written authorization.
- Service providers (web hosting, email, practice management and accounting software, payment processing), contractually bound to keep the information confidential and secure.
- Authorities, when the law requires it through a subpoena or court order, or the IRS and state agencies when you authorize us to represent you.
- Because we share nonpublic personal information with nonaffiliated third parties only within the exceptions the GLBA permits or with your consent, the law does not require an opt-out. If this practice changes, we will notify you in advance and give you the option to opt out.
6. How we protect it
We maintain a Written Information Security Plan (WISP) under the FTC Safeguards Rule and IRS Publication 4557. It includes periodic risk assessments, encryption, multi-factor authentication, role-based access, staff training, vendor oversight and a qualified individual responsible for the program. Card and ACH (Automated Clearing House) payments are processed through CPACharge (AffiniPay), a platform that complies with the Payment Card Industry Data Security Standard (PCI DSS). PAG does not receive or store your full card or account numbers, and never changes its payment instructions by email.
7. Security incidents
If unauthorized access to your personal information occurs, we will notify you without unreasonable delay and no later than 30 days after the determination, as FIPA requires. If the incident affects 500 or more Florida residents, we will also notify the Florida Department of Legal Affairs; if it affects more than 1,000, the consumer reporting agencies. If it involves unencrypted information of 500 or more consumers, we will notify the FTC within 30 days of discovery, and the IRS when taxpayer data is involved.
8. Retention and disposal
We retain information for as long as tax law, professional standards and our internal retention policy require. When that period ends, we dispose of it securely, as section 501.171(8), Florida Statutes, requires.
9. Cookies and analytics
The site uses essential cookies to function. Analytics cookies, such as Google Analytics, are activated only if you accept them in the banner, and you may decline or withdraw acceptance at any time. The site does not respond to browser Do Not Track signals; your preferences are managed through the cookie banner.
10. Communications
Our informational emails comply with the CAN-SPAM Act (Controlling the Assault of Non-Solicited Pornography And Marketing Act) and include an unsubscribe option. We will send text or WhatsApp messages only with your express authorization, under the Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act (FTSA; section 501.059). You may reply "STOP" at any time. We do not record calls or video conferences without the consent of all parties, as section 934.03, Florida Statutes, requires.
11. Children
The site is not directed to children under 13 and we do not knowingly collect their information, under the Children's Online Privacy Protection Act (COPPA). Tax information of minors is received only from their parents or legal guardians within an engagement.
12. Visitors from other countries
PAG serves clients in Latin America and Europe. Your information is processed and stored in the United States. If the law of your country grants you rights over your data, such as the European Union General Data Protection Regulation, we will honor your requests as applicable.
13. Your rights and choices
You may ask us for access to your information, its correction or update, withdraw consent for future uses and unsubscribe from informational communications. Some state laws grant additional rights; information covered by the GLBA may be exempt from them. We will respond within 45 days and may verify your identity before responding. Certain data must be retained by law even if deletion is requested.

15. Changes to this notice
We may update this notice. The effective date shows the current version; material changes will be announced on the site.
